Policeman dismissed over 'sexual activity' in cell

A Greater Manchester Police officer has been dismissed for failing to report "sexual activity with a female detainee in a police cell", the Police Complaints Commission has confirmed.

The 48-year-old constable appeared before a misconduct tribunal when he admitted visiting the female detainee in a police cell without a colleague being present, which is against Greater Manchester Police guidance.

According to the PCA, he later "failed to report" that anything untoward had occurred and, when challenged, "falsely declared" that sexual activity had not taken place.

The hearing was brought upon the recommendation of Police Complaints Authority member Mrs Anne Boustred, who had supervised the Greater Manchester Police investigation into the officer's conduct.

The woman had had to stay overnight at Longsight police station in March 2002. The officer was the gaoler and the custody record reveals that he made six visits to her cell. She complained that sexual activity took place in the cell, the PCA said.

The woman made a complaint of being sexually assaulted, as soon as she had left police custody. When the allegation was first put to the constable he denied it but confirmed that he was still wearing clothes from the previous day. This included blue boxer shorts, as described by the complainant. The officer was arrested, questioned and charged with two criminal charges.

In February he was found not guilty of misconduct in a public office and indecent assault. In April the PCA recommended and Greater Manchester Police agreed that he should face a misconduct hearing.

The constable has exercised his right of appeal against the outcome of the hearing.

Commenting after the hearing, Mrs Boustred said: "Male officers must not break guidelines and go into female cells on their own."

Community police officer remains critically ill

Police Officer Jailed For Cell Assault
A police officer who injured a woman in an assault in a police cell has been jailed for six months. Sergeant Mark Andrews, 37, was captured on CCTV dragging 59-year-old Pamela Somerville across the floor of Melksham police station in Wiltshire, before shoving her into a cell.
