Babysitter Granted Retrial For Toddler Death
A babysitter found guilty of murdering a two-year-old has been granted a retrial.
Suzanne Holdworth, 37, of Millpool Close, Hartlepool, has denied that she banged Kyle Fisher's head against a banister in a fit of temper.
Lawyers representing Ms Holdsworth claim that fresh evidence will clear her of the murder and that she has suffered a miscarriage of justice.
Ms Holdsworth had been babysitting Kyle while his 19-year-old single mother, Clare Fisher, was at a local nightclub in July 2004.
Kyle died of severe brain injuries two days after the alleged attack.
Detective Superintendent Tony Hutchinson of Cleveland police led the investigation into Kyle's death.
Ms Holdsworth's family have always maintained her innocence.
At the first trial in March 2005, Ms Holdsworth said that she did not batter or beat Kyle and that he "was a lovely little lad and was adored by us and particularly my youngest daughter".
It is reported that a leading neuro-pathologist said it was "unlikely" that an impact caused his death.
However, a jury at Teeside Crown Court found her guilty of murder in 2005. She was jailed for life and was told she must serve at least 10 years before she could apply for parole.
At a Court of Appeal hearing in April this year, Henry Blaxland QC said that new expert evidence suggested that a prolonged epileptic seizure brought on by an eye injury the child suffered at birth could have caused his death.
The Court of Appeal has agreed has granted Ms Holdsworth a retrial on the grounds of new evidence.
