DUP get go ahead on joint legal bids

The Democratic Unionist Party has been granted permission by the High Court to proceed with legal action against Northern Ireland First Minister David Trimble.

On Tuesday November 13, Mr Justice Kerr granted leave for DUP deputy leader, Peter Robinson, to incorporate an injunction into the judicial review he was granted last week against the Secretary of State’s decision to postpone Assembly elections until 2003.

Mr Robinson is seeking to restrain David Trimble and Mark Durkan from acting as First and Deputy First Minster of Northern Ireland’s devolved parliament on the grounds of failure to be elected by the statutory six-week midnight deadline on Saturday November 3.

A cross community majority in the Assembly four days later elected Mr Trimble and Mr Durkan as First and Deputy First Minister on Tuesday November 6.

The legal bid, brought by Mr Robinson and Mr Dodds is also challenging the Northern Ireland Secretary’s decision to postpone assembly elections until May 2003.

The case will come on for mention on 22 November and the hearing has been fixed for 3 December. (AMcE)
