New Statutory Miscarriage Leave And Pay For Northern Ireland

Economy Minister, Dr Caoimhe Archibald, has released the official consultation response regarding the implementation of statutory miscarriage leave and pay within Northern Ireland.

The move represents a significant expansion of employment rights, ensuring that parents who suffer a miscarriage or pregnancy loss at any stage receive the same protections currently afforded to those who experience a stillbirth or the death of a child under the age of 18. This includes two weeks of protected leave and statutory pay.

From 6 April 2026, Statutory Parental Bereavement Pay will be established as a day-one entitlement. This ensures that support is available immediately for parents affected by child death or stillbirth, with these strengthened protections specifically including those impacted by miscarriage.

The decision follows an extensive consultation process involving bereaved parents, trade unions, employers, and advocacy groups. The feedback underlined the importance of formal workplace recognition for the emotional toll of pregnancy loss.

Economy Minister Dr Caoimhe Archibald commented on the importance of the new measures: "Extending this right to women and their partners who experience miscarriage is a significant step in promoting compassion and understanding in the workplace. There is no hierarchy of bereavement. Miscarriage is a deeply personal loss, and these rights will ensure parents have the support and time they need to grieve and recover."

Expressing gratitude to the participants of the study, the Minister added: "I thank all those who contributed to the consultation. Your input has helped shape a policy aimed at providing meaningful support to those affected."

The Department for the Economy will now proceed with the necessary regulations to ensure the new entitlements are active by April 2026. The complete consultation response has been published on the Department's website - Miscarriage Leave and Pay
