DoJ Opens Consultation On Miscarriage Of Justice Compensation Caps

The Department of Justice has launched a public consultation on changes to the statutory overall limits for compensation in miscarriage of justice cases in Northern Ireland.

The lead proposal is a 30% uplift to the current caps administered by the Department. Under the plans, the new ceilings would be £1.3m where an individual has spent more than 10 years in custody and £650,000 in all other cases, mirroring the position recently adopted in England and Wales.

The consultation also seeks initial views on broader structural reforms: introducing a separate statutory maximum award for exceptionally long periods in custody, or removing statutory maximum awards entirely. Either option would require primary legislation.
