Appeal by death driver dismissed

The last chance to have a nine-year jail term overturned by a man who killed a 15-year old schoolgirl has failed at the Appeal Court in Belfast.

The Appeal Court dismissed an application by Henry Christopher (Harry) Marley, 22, from Colinward Street in Belfast, for leave to appeal his case to the House of Lords.

Jailed for nine years in 2003 for causing death by dangerous driving, Marley had also received a consecutive three-year sentence for theft.

Marley had originally denied being the driver who ran down and killed teenager Debbie McComb on the Springfield Road in a stolen car in March 2002.

However, Marley was convicted of causing her death. At Belfast Crown Court the judge handing down sentence described the incident as "the worst case of dangerous driving" he had encountered.

The Lord Chief Justice Sir Brian Kerr and Lord Justices Nicholson and Sheil, sitting in Appeal found that there was no point of law that would merit an appeal to the House of Lords and dismissed the application.
