Mother freed in baby death case

A mother who was convicted of killing her two babies has had her life sentence over-turned by the Court of Appeal.

Donna Anthony, 31, was convicted of the murder of her two children – Jordan and Michael – in November 1998 at Bristol Crown Court. Eleven-month-old Jordan died in February 1996 and four-month-old Michael died in March 1997.

Mrs Anthony, who was granted bail by the Court of Appeal last month, had originally appealed against the convictions in June 2000, but her case was dismissed. However, she applied to the Criminal Case Review Commission (CCRC) in September 2003, which decided to refer her case to the Court of Appeal again.

Mrs Anthony's case is one of 28, which will be reviewed following the overturning of Angela Canning's murder conviction. Mrs Canning's conviction – for killing her sons, seven-week-old Jason and eighteen-week-old Matthew – was quashed in December 2003.

The prosecution in Mrs Anthony's case had relied on evidence from paediatrician Sir Roy Meadows, whose evidence was since discredited in a number of other cases.

Mrs Anthony has always maintained that she was wrongly convicted and claimed that her children were victims of 'cot death'.

It had been reported that there was new evidence in Mrs Anthony's case, including the possibility that her son Michael may have died from natural causes.

Mrs Anthony's counsel, Ray Tully, had told the Court of Appeal the expert evidence at Mrs Anthony's trial was "flawed" and that the convictions were "wrong" and "unsafe".

The Crown Prosecution Service did not oppose the appeal.
