Day Denies Drink Driving Charge

Actor and singer Darren Day has today pleaded not guilty to a charge of drink driving.

Day, 40, of Pontefract Road, has denied driving his car through a red light in the city centre three weeks ago, while nearly double the legal alcohol limit .

It is understood that the performer failed to provide a breathalyser sample three times after being apprehended by police - and just hours after appearing on stage in the musical Hello, Dolly!

Police stopped Day who was driving a Mercedes after the performance at Cardiff's New Theatre.

Prosecuting, Lynne Bartlett, said that "at 1.50am officers on routine patrol say they observed Mr Day's car travelling at speed in the opposite direction while they stopped at a junction".

"They turned their car round as Mr Day drove through a red light," she said.

The court heard that officers attempted to use a breathalyser test at the roadside but it was unable to give a reading.

It is understood that after Day had been arrested and retested, he had 65 microgrammes of alcohol in 100 millilitres of breath. The legal limit is 35 microgrammes.

Day's legal representation, Jenny Kumeta told the court that "he had been in the car no more than 20 seconds with the engine on when police called him over".

Miss Kumeta said there were "further issues" she needed to explore about whether the police's roadside breath testing kit was working.

Day has been granted unconditional bail at Cardiff Magistrates' Court for trial on August 27.

Day is currently starring as Cornelius Hackl in Hello, Dolly! At the Empire Theatre in Liverpool.
